Author Topic: Mixed Message On AOS Interview...Little Long.  (Read 1301 times)

For all you who have been there...
My wife arrived here last April 25th,01 and we got married in July.
Things have been well.We filed in person at Boston her AOS papers and after a few of "their" clerical mix-ups we finally got a date for her AOS interview and attended it.
At the interview the interview guy knew we were together married still because we just had a new-born and he was with us at the interview.
The next thing the guy did was ask my wife if she believed in communism and if she ever lies...
Duh!!!!!

After answering him "no" on both questions he went on to congratulate her telling her he was approving her AOS and stamped her passport with the I-551 explaining to her she now was considered a "conditional permanent resident",that she should receive her green card with-in 6 to 8 months and that she'll need to file again 90 days before her green card expires.Travel supposedly is allowed now with-out advanced parole and apperantely her count-down to be able to apply for citizenship is 2 years beginning with the date of her I-551 stamp in her passport...

My Questions...Did I interpete this all correctly on the timeframes?
What will her next interview (in 2 more years) be for?
She was asked at the interview if she intended on working.(Not now with a new-born).Do amounts on tax returns have anything to do anymore now that she already has been approved on her AOS or will it be an issue at her next interview if she never works and stays a homemaker?
Finally,if she wants to travel with the I-551 stamp in her passport before she receives the green card,will it be a problem?

Yes, it is my understanding that your wife can now travel outside the country with the temporary green card in her passport. I know of a UW that just returned with no hassels from either side.

As far as time frames...every INS district is different, we were told at our AOS submittal to expect a letter in 6 months and to expect an interview date a few weeks after that. I doubt it, but will no one knows for sure right now.

I think your wifes EAD card has expired, or will expire before she recieves her green card..it is good for one year after AOS, maybe that is what your INS agent meant about re-filing, her SSN card is also temporary so maybe that is why the agent is asking if she intends to work??

Rick, your wife had received conditional green card. In 2 years you  should send petition for removing of condition from her green card  and so her status will become permanent resident.INS may schedule both of you for interview or may not.Alot of times INS schedule couples for interview when they find something to be suspicious or simply not satisfied with paperwork you'll submit.In my case we have tons of support documentation plus we hade child together.Still we were scheduled for interview.I think your wife can travel without problems with her current status.But since I didn't travel I can't tell you for sure.To become a citizen she should have 3 years of permanent residency in US and to be married for 3 years.
