When I posted my first response, I didn't notice that you had an attorney.  Pretty useless one, actually, if he/she isn't able to tell you what to do in this situation.

For those of you thinking about getting an attorney to do this, keep this example in mind.  IMO, the only reason to get an attorney (unless your individual case has complications) is to help out in situations like this.  Here, someone who really needs help isn't finding that having an attorney is any benefit...

Sorry to hear about your situation.  I don't agree that is it just a matter of waiting longer, but don't remember what the correct response is.

To find it, try searching the archives--here and on the newsgroup (alt.visa.us.marriage-based) for a guy named Chris (?) who had the same problem a while back (perhaps spring).  I think he actually had the 6-month approval period expire waiting for the NOA to get sent.

I believe it took Congressional involvement, so it is best to get started on this quickly.

Good luck,

Steve M.

Hi Mike,
The better question to ask people is whether any Nebraska Service Center applicants who received their 2nd NOA (the approval) AFTER September 28, 2001 have had the MOSCOW embassy receive notification from the INS of the approval.  The further question is whether they requested (and paid for) cabling of their approval.
Mike and I have corresponded privately.  Mike's approval was in the Sept 24-29 time period.  Other applicants have been told by the Moscow embassy that none of the approved applicants (from that time period) have had their notification received by Moscow.  That IS ridiculous.
My concern is that I just received our approval (November 6) and I don't want to wait and wait and wait like Mike and others.  Any comments??

Thanks
Dave
