Fellow gringos, need I remind you that I have seen more than my share of failed relationships costing both dollars and financial hardship. You can listen to the agency hype, those with their heads in the clouds or you can proceed with caution and listen to your papi.

I recently received a letter from an Associate Member of the Club expressing concern that gringos do not know what they are doing regarding prenupts. In this particular case, the writer was most concerned with the short window on signing the paperwork prior to marriage. Seek proper legal counsel.

On a positive note, many relationships do succeed as noted by some of the readership. I wish you luck in your search.

I agrees with you that a Pre nup that is signed with a foreign women that has to sign this or she can return to her country. That is why you must and i mean must have a Pre Nup signed before marrage and then after 6 months or more you have a post Nup signed this way it will hold up in a court of law and this has been tested and proven.

good point. I am not an attorney but feel that a competent lawyer should be able to put together a solid prenupt. Frankly, the best plan is to avoid bringing them to the USA altogether, but that is not always logistically feasible.

Except under issues of duress and fundamental fairness. Then all bets are off. I do hope you had an attorney in your area do your pre-nup.

Keep in mind that the prenup only comes into play during dissolution and is only needed when a party-usually the man in these relationships- doesnt want to abide by the laws of his state and give what is considered to be a fair share of the assets.

The State Bar of California training classes on prenups state that most people do not need them at all. This is also an area in change right now. Legislatures have a habit of undoing the work that you all are putting into them.
