Went to Social Security with passport and Rosie's 1-94 and the lady says we now also need an EAD as well, before Rosie can get her Social Security card. It's no big deal, since Rosie will take her N-CLEX nursing exam first anyway. But i have a few questions.

What are all the forms besides the EAD and AOS that we need to fill out? Are they simple or should we get a lawyer? What are the steps to getting her green card? Are all these forms available from my local INS? Will the INS accept downloaded forms? Thanks for helping us out as always.

Technically, a K-1 is authorized to work during the 90-day visa period. Some SSA offices will give K-1s an SS card without an EAD and other offices won’t. Don’t bother applying for an EAD before you file AOS because she probably won’t get the EAD before her visa expires. After the 90-day visa period, she would have to file for a NEW EAD anyway at another $110 application fee. If she doesn’t plan to work now, then I wouldn’t worry about it. You could try another SSA office if you want to.

The forms are no big deal and you will not need an attorney. You can call the BCIS to order them by mail for free. Downloaded forms are also fine. Download or use the fillable forms from the BCIS Web site. Some of the forms you will need:

G-325A
I-765
I-131

Tip: Be sure to apply for Advance Parole and EAD along with the AOS.
