Author Topic: Update I-129 processing times for Nebraska  (Read 3130 times)

Ok my petition is now 100 days old(my reciept is dated May 1st). I called the Nebraska service center to see what the deal is. After redialing for about 45 mins I was able to connect. A rep answered the phone quickly. I gave my receipt number. She informs me that it is taking longer than the max estimated time (read longer than 100 days). This is due to september 11th and extra procedure etc.etc.etc. I asked her what date of files they were working on now. She goes on to tell me the most current file they are working on as of August 2nd is from April 22. This is the same date I was told they were working on July 14th. So the past month they have not processed one single I-129f.

When I told her about the status from July 14th she did not have an answer for me other than they are busy. When I mentioned that other centers are able to process requests in 3-5 weeks she informs me she has no idea what thier staffing levels and backlog are and can not comment.

When asked what channels I can use to escalate this, she tells me this petition has no escalation process. Since my date is May 1st and they are working on April 22nd I should expect my petition to be processed in a week or two. I told her that was what I expected back in July 14th.

Is it normal for them to not process any petitions for 2+ weeks at a time?

Also, is there anything I can do to get this escalated? Some people say contact a congressman. Would that help in this case?

Thanks for letting me vent and any helpful adice given.

Someone on here said that complaining through a congressman actually slowed things down...

I can't remember the details, but it seems that I read it here not too long ago..

this is true a lawyer friend of mine told me this, and it does piss them off. You would probbaly 100% get approval. Use a congressman as last resort. It does increase the time because it then has to go through a congressional inqurey

I suspect you were just making a point - but that is a bit "over the top."

No-one knows if asking a congressman for assistance/intervention actually causes any slowdown effect.

I absolutely, positively, know that my congressman's aide's inquiries on my behalf *shortened* our wait time.

All this talk about the INS slowing things down once a congresman gets involved is pure speculation. There is NO empirical evidence to support that crap. None!

Now I haven't been thru this before (submitted my papers to Nebraska 8 weeks ago) but I have a feeling that not all of the staff know exactly what dates they are processing for.  I find it very, very hard to believe they haven't processed one single K-1 in over a month.. I just don't see that as possible.  I just think it's like the IRS, you can never get a straight answer.  You may be surprised when you get your approval tomorrow! LOL!

As far as escalating things through the use of congressmen etc..  They say right on their web site that this will make NO difference and I think personally it just pisses them off, so it might make them more just want to set your petition aside!  Kinda like complaining to the waiter that you don't like your meal, so they take it back and the chef spits on it!  ;-)

Just my thoughts-

I wonder if they only get the new mail every 2 weeks or so...it is a po box. That way if they say they are processing stuff from 4/22 they actually may be processing 2 weeks worth of stuff from a big pile they picked up on the 22nd... who knows. If they are 3 months behind why waste the manpower going to the post office every day..

They recieved my priority mail and signed for it on friday 8/2/2002 and cashed the check 8/7/2002..hehe they are quick to take the money huh? Smiley

They said they did not have my documents, I think it was just a stall tactic. 14 working days to find out the papers were lost and they now have them. I sent them to them june 8. 14 to 21 working days to find out that they wanted more info. ten days to find out what was missing. They would not tell me on the phone or in person what they wanted for info even after traveling 300 miles. july 29 I travel 300 miles again to give them of all things, a copy of the my girls divorce paper, I had already given them a death certificate and divorce paper of her ex. More photos and more proof of contact. also adit photos of myself. this was all given to them twice now. august 1 they say normally 14 to 21 days to finish but, because they were already looked at it will take 21 days. so here I sit waiting for somewhere around the 29 to see if they aprove them. All i can say if this were a private company they would have been out of business along time ago. Rick
