HOW DO I GO ABOUT GETTING A FIANCE VISA FOR A WOMAN I MET IN RUSSIA LAST NOVEMBER. HOPEFULLY, I CAN DO IT MYSELF. DOES ANYONE HAVE A STEP BY STEP METHOD? I WANT TO KEEP MY COST DOWN AS WELL. A LAWYER QUOTED ME FIVE THOUSAND DOLLARS TO DO THE JOB AND I TOLD HIM NO. THIS IS MY FIRST POST, I THINK.

THANKS,

DANIEL PEREZ

Daniel, Here is a checklist for getting the K-1 fiance visa.  The initial step is to file the I-129F petition with the INS.  This can and has been repeatedly done without a lawyer, although some people feel more comfortable paying a lawyer.  The fee that you were quoted is highly excessive - I wouldn't pay more than $1,000 and that in my view is a waste of money because all that is involved is assembling the application and appropriate documents.  The forms may be found and downloaded from the INS website.  Basically, you must present:  1) the I-129F petition form 2) G-325 biographical information on you and your fiance, along with photos.  The G-325 form must be signed by fiance.  3) your birth certificate and any divorce decrees, 4) her birth certificate (with English translation) and any divorce decrees (with English translation) 5) if there are children involved, you will need their birth certificates along with English translations of same.  6)letter or memo describing  the circumstances of your meeting.  Here you need to provide photos, air tickets, phone bills, e-mails and any other information showing that you have previously met and communicated with a view to marriage.  The amount of data varies, but the more information you have the better.  I can provide you the letter I used that several others have successfully used.  Your application should follow the INS guidelines for submitting applications that are found on the INS website.  You pay the fee, which apparently is now $110 and file the application.  You will receive a First Notice of Action(NOA) when it is received and a Second Notice of Action (NOA) when it is approved.  The timing seems to vary with the INS Service Center that you file with.  Vermont is by far the fastest and if you have a close relative that lives in the Northeast U.S. I highly recommend you use their address for the filing of the I-129F.  Once the I-129F is approved, consult the U.S. Embassy Moscow Website in Russia for procedures to obtain the medical examination and visa interview, or better yet, post again and I am sure that there are several people on this board that can give you some insights into that aspect of the process.  My wife is from Ukraine, so I can't help too much on Moscow.

The first thing you have to do is to file a petition. This is the I129f form you will need her to sign it.you will also need from her all certified and translated birth certificate and a paper that says they are not married  and a letter written by her stating that she will marry you with in the 90 days after coming here. a copy of her passport. you Will also have to summit a biographic form on her life where she has lived, worked and parents name and things like that. All these forms are in your local ins site. you can download them and print them. That is the best i can tell you for now Rick

Need a bit of clarification there snow.. You say :

"you will also need from her all certified and translated birth certificate and a paper that says they are not married and a letter written by her stating that she will marry you with in the 90 days after coming here"

Is that a certified copy of a letter stating she is not married?

Dex,

It would be very helpful for you to check out the Doc Steen website, I think you can get to it from the left side of the board here..  It will explain to you about the letters you are taking about, how to word them etc..
You both need to submit a "letter of intention to marry".  Just have her send you a blank piece of paper with her signature on it, when she sends you her other papers.  Then you can write the letter that basically states that she is not currently married, is legally able and willing to marry and that she is planning to marry you within 90 days of her coming here.  It doesn't need to be certified or translated (it will be in English because you will write it in English!).

That site will help you with all of this..

Good luck

Stop posting in caps and you might get an answer... unless of course you're blind and I'll apologize in advance.  Check out apex visa services which is listed in the home page somewhere of planet-love.com.  Or even hervisa.com

To give you an idea of what you have to do is to go to the us embassy site in warsaw thier is more info there then in the american sites. Go to the site and look under visa consular service and look in immigrant visas that should be to the right of the screen. The site address is www.usinfo.pl/consular/iv/iv.htm  rick
