I was talking to the INS hotline today with a question or two regarding the I-485 (adjustment of status)...They told me that you had to file IRS form 9003 with it...that was the first time I had heard anything like that

Anyone heard of the IRS 9003 before???

I called the IRS and they didn't know, and it's not on the web site...and it's not in the directions of the I-485...but TWO INS hotline people said it was required....ahhhhh the Government...what a well-oiled service machine!!

Thanks for the responses...We decided to go down to the INS office and take our chances.  From start to finish, it took us about 3hrs 45min...all but 15 minutes of that was waiting.  After we waited outside for 1 1/2 hrs, we then got to wait again in the line to recieve a number to wait again...LOL.  I asked the woman about the form (9003), and sure enough, she gave me one.

Turns out I didn't need it.  I think we got really lucky.  When we were finally called into the interview for the adjustment of status, the INS officer (who was extremely nice--so lucky) said everything looked good, in terms of my paperwork.  He proceeded to fingerprint her and had her sign some forms.  

Bottom line:  We recieved a stamp in her passport which was conditional PERMANENT resident status, good for one year. The stamp was a courtesy, meant to be in effect until we recieved the card in the mail.  The stamp also gives her immediate permission to leave and re-enter the country AND to work.  So, we didn't have to file for EAD OR ADVANCED PAROLE, saving us both time and $200 or so.

Finally got something good for my tax $$'s

It is a real form.  In July at the embassy I filed it in bogota.  It is a statement that states that your wife never filed tax returns for prvious years in the USA.  Sorry but I do not have any more copies of it.

My wife just filed AOS a few months ago, I'm almost certain there was no such form in the info that the attorney had us complete and submit.

I went to IRS' website.  I couldn't find a Form 9003.

The IRS publication that deals with aliens is Publication 519 - U.S. Tax Guide For Aliens.

I would suggest that you download this publication and read it.  I did a quick search for Form 9003 in Pub 519 - the search results were 0 documents found.

Here is what I would do:  call IRS at 1-800-829-1040 and ask them if there is such a thing as a Form 9003.  If so, ask the representative to send you one.  If IRS says that there is no such form, then call INS back and explain to them that you called IRS and there is no form.   Ask the INS representative to clarify if it is Form 9003 that they want.

Mike - I worked for IRS for almost 11 years, and I worked in public accounting as a CPA, doing tax returns.  There are some tax forms that are very, very rarely used.  This "Form 9003" might be one of them.
