Now then, we'll be filing for AOS (and an EAD extension along with advance parole) this week. What happens in March when her K-3 expires? Because we've applied for AOS are we still 'in status' despite the date on the visa? For people in such situations, what tangible evidence do they have that they are 'in status'? As long as you file AOS within the 90-day period she has every right to stay. Advisable she not leave the country until she receives the AP, which usually occurs fairly quickly. Although you can generate all kinds of proof if you just think about it, this tends to be one of those "in limbo" periods when it is simply better to keep your head down -- because proof is not as simple as just showing her green card. |
