I am going shortly to Ukraine, one of the girls that I will be seeing and like an awful lot, went to the USA on a fiancee visa and subsequently returned within a month of her arrival because it didn't work out (several reasons why, no point discussing now ). My question is will this make it harder, easier or no make no difference for her getting another K1visa to come over to USA. Thank you. Title: Re: harder or easier????????? I reckon easier.. after all she RETURNED within a month and didn't try to go the illegal route, this must be a plus point? just my thoughts, and I guess she remembers the procedure. When I visited the US Embassy in Moscow I was told that there is no problem for a potential MOB from the FSU to use a K1 visa more than once. As long as they return to the FSU within the 90 days allowance. If they stay more than 90 days they would be in trouble. In the case you describe there should not be any difficulty. Why did she leave ? Unhappy with life in rural Iowa. Before we can give you a valid answer, we must know the reasons for her departure. Heck, for all we know she married a guy and then killed him for his life insurance money! He's not asking for advice about the woman... He wants to know if the fact that she has been here before will make it harder for her to get a fiance Visa the second time around... We don't have to know why she left the first guy for that... Sheesh! The answer to your question is that thoeretically, it should make no difference. Whether that holds true in practice is a matter of some debate. However, my experience with government tells me that no one at the INS department will probably remember her... And depending on where you file (as opposed to where her ex-boyfriend filed before) it may well be that the application will go to a different department anyway. So, I wouldn't worry about it, if I were you... Hi Mark, How are you?? Let me add to your thoughts...as I am in the middle/end? of my second application for the same girl... the forms clearly ask if you have filed a I-129F in the past, and give the details...etc etc...better to fill out the forms as asked in the beginning, then to try to explain a "situation" later... ..and let's not forget the fact the even the INS is somewhat computerized now.... Hey there, I'm doing great, thanks for asking. I'm starting to put together another trip to Kiev to see my Lady. (I hate this waiting!) My INS Dept averages 3 months, and I filed in July, so I should hear something by the end of this month or by mid October. One good thing is, like I said, at least frequent flyer miles go down after October 15th. Which is good, because I didn't have the 60,000 needed, but I do have the 40,000 which it takes in October. How about you? How are things going on the "Left Coast?" I hope things work out for you. It sounds as though Moscow and Warsaw are taking different tacks on this process. Where do you stand? Are you sure you won't get your Visa quickly? Or is there still a chance? |
