Post by: dcphaethon on February 24, 2002, 05:00:00 AM After my fiancee comes to the US and we get married, how long would she need to wait (after our marriage) until she can go back to Russia to visit? Would we need to wait until the paperwork for AOS had been completely completed and then file an advanced parole? Or could she depart on advanced parole before AOS had been completed?
I'm really searching for the "safest" solution here. That is, how long would it take for AOS to be finalized plus the time for the I-131 advanced parole form to be completed with INS? The answer to your questions is yes, she can depart on advance parole before the AOS is completed. You should file for AOS as soon as possible after you are married. You can file for advance parole at the same time that you file for AOS. INS will rule on the advance parole before the AOS is finalized. You should consult the local procedures for your area from the INS website to see how it is done in your area. Each area is different. |
