Title: Q about filing form I-130 for wife...

I said I'd pop in from time to time...but it looks like I'm posting like I did in the old days.  ;)

Anyway, my wife and I were married in the US (in the proper amount of time) after she came to the US on a K-1 visa. However, she returned home to be with her ailing mother after her mother and grandfather were involved in a car wreck. My wife left before we could receive travel authorization and before we could file for adjustment of status. Now we're preparing everything for the I-130/K3 process and we have two questions about form I-130:

B:16. Has your relative ever been under immigration proceedings?

Yes___ No___ Where________ When______
Exclusion___ Deportation___ Recission___ Judicial Proceedings___

D:2. Have you ever filed a petition for this or any other alien before?
Yes___ No___

I'm guessing 'No' to the first...and maybe 'Yes' for the second. Any ideas? I thank you in advance.

Your guess is correct.  She has not been the subject of an INS proceeding but did file a petition for the K-1 visa. It's a shame that this happenned and you have to do this again.  See my post above on this if it happens again.

I thank you and everyone else who provided input on the situation.  After I finish completing the PDF forms using Photoshop, I'll submit everything!
