Title: Q about filing form I-130 for wife... Post by: DR on November 30, 2001, 05:00:00 AM I said I'd pop in from time to time...but it looks like I'm posting like I did in the old days. ;)
Anyway, my wife and I were married in the US (in the proper amount of time) after she came to the US on a K-1 visa. However, she returned home to be with her ailing mother after her mother and grandfather were involved in a car wreck. My wife left before we could receive travel authorization and before we could file for adjustment of status. Now we're preparing everything for the I-130/K3 process and we have two questions about form I-130: B:16. Has your relative ever been under immigration proceedings? Yes___ No___ Where________ When______ D:2. Have you ever filed a petition for this or any other alien before? I'm guessing 'No' to the first...and maybe 'Yes' for the second. Any ideas? Your guess is correct. She has not been the subject of an INS proceeding but did file a petition for the K-1 visa. It's a shame that this happenned and you have to do this again.
