Author Topic: I-751--Removing Conditional Status---Question  (Read 8379 times)

For anyone who has done this themselves--It appears there is only one form to submit for this, the I-751 form. Is this correct, or are there others that must be submitted with it? I realize of course that evidence of joint relationship must be submitted also along with it.

You will need this web site later to follow on the status of your I-751   http://uscis.gov/graphics/index.htm ... on the right hand side click on "Processing Dates" ... then under the heading of "Obtaining a list of Processing Dates" it will have 3 choices, click on "Service Center processing dates " ...then select the center you want, click on "show table" ....and it will give you the date of every single case that service center is currently working on ... ALL of them ... they show I-130,I-129, etc .. They update it often it looks like, I just looked and they are on March now... (GOOD) the are moving at least .. you can also go back to the where you cliked on service center processing dates ...above it shows where you can click for status on line ... I havent seen jack  ..but since they are just on March 03 and my letter states July 03 I shouldnt be suprised. Im still calling though to update my address, plus double check them.

Thats it, just submit that form with all your info...such as tax return, car insurance info, banking info, bills...anything with both your names on it....it shows your tied together....the more the better, pictures....well, I didnt send any, probably should have...but didnt.....if they dont get the picture with all the info I sent, then they were going to call us in for an interview anyway.....I sent an overwhemling amount of info showing how much we are financialy intertwined... Ive been waiting 7 months now on them to send me something regarding our interview or no interview..... You can look up the case # they issue online. Texas Service Center is back up ... and just now getting to the Feb 03 I-751 cases ...look like they are backed up about a year....?

I just used the one form,thats the number I think.They want you to submit letters from 2 people who say they have known you as husband and wife.Plus any eveidence of point ownership of property,utility bills,bank accounts.
When we applied my ex wife got a one year extension of her 2 year card.It was just a letter but she was able to travel with it.
We got a letter in about 7 months seting an interview 2 months later,9 months after we sent in the form.We had a set time appointment and we got right in in the appointment line.We wated mayber 15 miniutes and we went in for what was about a 30 miniute interview.It could have been over in 20 min but we asked some questions.They said we had you come in for the interview because of insufficient evidence  
that you are living as husband and wife,but I think the interview is almost always the case.We showed him some photo albums and he was satisfied.She got an extension paper on the spot and her 10 year card in the mail in 3 or 4 weeks.He gave he papers to apply for citizenship and said it would take about 2 1/2 years from there.
It was easy,no problem,but everything was the truth.

Thanks Pete. Did you send alot of "joint evidence" with the form and they still made you come for an interview, or did they see your photos, etc. for the first time at the interview? Point being, the evidence I send with the form will basically be the same as what we would take with us to an interview. Kind of redundant, but so is alot of this process.

We did not have alot of joint evidence.The house and utilities were in my name.We sent them copies of her drivers licence and bank accout,which were in her name only.
The question I guess is if the joint evidence is good enough would there be no interview.I doubt it,I thionk they would still want to talk to you,alot of joint evidence can be faked.

My guess is that the interview in mandatory.  I was in the same boat and had opened an individual account for my wife - the question did come up "why no joint account?".  I responded "she likes to shop more than I do".  Whole interview was lighthearted, quick and painless - might have been luck of the draw in my case but I found it pleasant to actually speak to a real person at INS after all the distant contact preceding the interview.  Filing jointly on tax returns was probably all they needed to have in their records?

I sent the I-751 form back in July. About a month and half later, I recieve a 1 year extension letter for her Green Card. The Green Card has expired. It has been 7 months now, and havent heard anything. I looked on the Texas Service Center Web Site and saw that they are just now on Feb 03 I-751 approvals to remove the conditional status. It looks like I have a few more months to wait. Im going to call  later this month  though just to check, especialy since I have moved and the address is different when I sent the I-751 form. I have to send them my new address. I sent my form with a copy of our joint tax statement.. we are both on, checking and savings.... we are both on, copy of my contract for my house ..which we are both on, car insurance ...we are both on, copy of some bills....we are both on......so it should be self evident we are together ...at least financialy, I still suspect they will call us to an interview. I'll find out soon enough this year if they call us in for the interview.

Thanks. BTW, You did answer my recent questions about accessing your money while in SA in your recent email, I appreciate the info. I have found that alot can be learned from the RV/motorhome crowd who is doing that full time. They have some pretty good ideas and methods for receiving/forwarding their mail, etc. even though they don't really have a stationary residence.
