Hi everyone,

It is getting that time in my relationship with Maria to think about getting a K1 visa.   Last time I was in Cali, in early October of this year, we had a "spirited" conversation about the little things that are different about each other.  

Well...the outcome of the conversation was a thought from Maria.  To the effect of, 'You have been here to see my family, friends, and how I live.  I would like to see how you live...it is only fair.'

And I agree with that very much!!  We really love each other and although we have differences, we have been able to talk about those differences and learn so much about each other.  Plus, I always look forward to what follows an argument!  Wink

The question I have, has been burning a hole in the side of my head and I really don't know what the answer is.  And I have not found the answer through searching the internet.  My question:  Maria comes here on a K1 visa.  It is getting close to the deadline to get married but we are just not sure yet.  Maybe she needs more time to think about it...I don't know.   What happens after she goes back to Cali?  I can still go down there, marry her there, and bring her back, right?

Well this is tricky. K1 actually expects that you already made a desicion and she comes in with the intent to marry, nothing less. Indeed this is not an obligation to marry but should you (and her) not excercise your K1 intentions, your abilities to obtain K1 in the future will be undermined. If she leaves and you go back to Cali and oficially marry her there and then bring it to the US (as a wife), this will fly though. If she comes, things dont work out and she leaves (or illegaly stays) you screwed yourself up for future K1 applications. Remember that 90 days given to you by K1 are for marriage preparations, not for getting to know each other. To apply for K1 (fiancee) visa you are expected to have known the person (prior to K1 application) well enough to decide to marry her.

The INS will give you multiple K-1s if she leaves at or before the 90 days.  There is no disadvantage as long as she doesn't violate her visa.

You could also do a consular filing later after she returns.  The INS understands what is going on, and will give you another k-1.  A hassle but better then getting married unsure.

Do you know this to be true from experience?  I was told, and mind you I don't know first hand, but I was told you got one K-1 visa with a woman and that was it.

I heard it from my immigration lawyer.

You can ask one yourself, but you can do another one if she doesn't break any laws.

I'd reccommend to ask the question over on the Russian board of PL.  Those guys are experts over there.

recall also hearing from Gary Bala that you can do multiple K-1 visas as long as no laws were broken.
