What an experience filling out these visa forms. Does anybody know if I should list the children of my fiance on my I-129F even if they will not be coming to live with us. The INS forms indicate I must list them. Except then they will now assume they are traveling with us. All there information leads me to believe that if you put them on the K-1 I-129F that the INS assumes they will be immigrating, and they don't ask any questions that would indicate otherwise.

I asked INS that very question about a month ago. They said ONLY list the children that you intend to K-2 off of her K-1. My lady, being a little older than 19 (ha ha, sorry Wayne's friend) has a 23yo, a 21yo and a 17yo. 17 chooses to stay with his father and of course the other two are too old for K-2 anyway.

Mike your answer to my question seems to make sense. Can you believe the vagueness of these forms. I don't think they even know what is correct since they tell you to list them even if they are not traveling (at this time), Well that wording assumes they will be traveling later, rather then not at all. Also did you know that 3 INS offices charge you $140 to cable the approval notice to the embassy in Bogota, but the Vermont INS office does it for free. How's that work

Craig - even though they ask you to list her children, I believe the K-1 visa will only be for her and not them.  There is a separate visa for the children = K-2.  I would list them.

There's links to forums and FAQs that deal specifically with immigration issues.   You're more likely to find someone on those messages boards who's been through this exact scenario than you are here.
