I was engaged to a woman from a foreign country and filed the K1 visa. Although she was approved by the INS here before she had her interveiw with the US embassy in her country we broke off our engagement and decided we were not right for each other. She NEVER had her interveiw with the consulate. My question is I have met someone special in Cali (not the same country as my former fiance) and if it eventually leads to filing of the K1, which is most likely, is the previous filing going to cause me problems. Does anyone know the expiration for the INS approval of your K1 filiing? I am hoping that the first filing will just expire and I wont have to worry about it. I realize that a lawyer is the best way to go but the first filing was so easy I hate to spend all that $$ for something that may be simple. Does anyone know this? Has anyone filed the K1 not have it work out and then file another one? and if so were there complications. Thanks fellas...

Rufus - I believe the time limit for the woman to go for the interview is 6 months after the date of approval.  6 months is the expiration time after the approval.

It will most likely not cause you problems, but I would suggest withdrawing your petition. Being honest surely wins points with INS. Also while it might not cause problems for you it will almost certainly for her if she were to ever meet another "gringo".

My wife was married to an american years ago, but never came to the states. They grew apart, and she figured it was all behind her. Wrong!

When we went for my K1 interview with her, we had big problems. At first immigration was telling me she could never enter the US. We sort of found a loop hole, and once all her paperwork is final with all the is dotted and ts crossed, I'll post the horror story with a very happy ending. Seriously would make a great book. Turned into quite the "adventure".

So for the lady's sake, I'df suggest you withdraw your petition.
