Author Topic: G325 form / Agency problems.  (Read 5312 times)

Me and my fiance have a problem.

She was working in another country for about 6 months through
an agency that found her work. The agency reported to her
just lately that she has a 3 year contract through them,
but she doesn't ever remember signing a contract for that.
Could this interfere with the process of getting her here?
It is an independent agency and they don't even have contact
with her now, but she was told this when she tried to get
the address and information about her employment abroad.

With that said, I just received the G325a forms from her
via FedEx but they are incomplete. She's not the best at
writing things out, so can I write up the papers, or type
them out on the computer, and just have her sign them?

I'm going to have to FedEx new ones to her again. We are
having problems with her residential address, and company
information when she was living in the foreign country.
She's unable to locate the street address of where she
lived when there, and the actual name of the factory
where she worked. Is it essential to have this street
address, and the name of the exact company on the G325
forms? It was a textile factory where she worked at.

She has a SS# on the form, so they should be able to pull
up her employment through that. The problem is that she
has gone back home to rural Leyte, and doesn't have access
to the internet, or anything down there to assist her
with gathering any additional information regarding it.

If anyone that has gone through this process, could
shed a little light on this for me, I'd appreciate it.
It is quite frustrating, and she's worried about it.

Yes, you can fill out the forms for her and then have her sign and date them.

It’s important to try to have accurate information on the immigration forms, and foreign employment and residence will likely be looked at very closely with the new security measures in effect. She can’t remember signing a contract, what company she worked at, or what street she lived on? How long ago was this? I guess she will just have to remember.

Depending on the country, if she was there for at least 6 months, she may need a foreign police clearance and employment/residence address will likely be required to apply for the clearance. Have her send you photocopies of all pages of her passport so you can verify the dates she was overseas. The embassy will sometimes ask to see all old passports to check overseas travel.

She may have to make a trip to Manila or wherever the agency is located to get the information if she has no way to get it from where she is.

Thanks for the advice. Yes, I know it sounds odd.

I'll get a copy of her passport. She was in Brunei
at a textile factory.. but doesn't have the name
of it, or the address of the place where she lived.

She said that she signed up for a 6 month work
detail, but they changed it on her to 3 years. I
don't have it completely figured out yet, but lets
say they have something that says 3 years.. will
this information ever come into play when processing
her k-1 visa, or just be lost on a shelf at the agency?

I guess I could always get a lawyer or something, to
try and get her out of it.. or get it straightened out.

It is just frustrating because she went all of the
way up to Manila from Southern Leyte to get this done,
and she sent me a packet of stuff back.. and the forms
need to be re-done, but she's back in Southern Leyte now..
and she is way out there.. with no internet, etc. I hate
for her to have to turn around and go right back to Manila.

JJ,

The last I heard, a police clearance IS required from Brunei, but is only available through the U.S. Embassy or Consulate. I would contact the embassy in Manila or ST. Luke’s for specifics on how to order the police certificate from Brunei.

If she already went to the agency and they refused to help her, then find another way to get the information. I don’t see how the agency could mess with her visa processing. Don’t worry about a lawyer unless the agency sues her in court or something. Once you get into the legal system over there, there is no telling how long you will be tied up in the courts. I would ignore the agency unless and until they become a real problem.

Thanks for the advice, Ray. I really appreciate it.

I'll check with the embassy about getting a police
clearance from Brunei. Basically, what is it? A
record that shows no crimes were committed there?

Also, do I need this police clearance right now, or
in the second stage when I send out the AOS, etc? I
didn't notice anything about it in the forms for now.

JJ,

Yes, the police certificate is essentially just a report that hopefully says that she has no record of being arrested for criminal activity in that country.

She will need the police clearances before she goes for the medical exam and visa interview in Manila.
