Those of you using I-130 Spousal visas will be interested in this. Go to this link to read recent news about the new K-3 and V visas available to expedite your reunion. It appears as if you can take action NOW to get the ball rolling for a K-3, if you have an I-130 awaiting approval. Good Luck !

I read the info at State and it looks like they screwed it up again. To qualify for the K-3 visa, step 2 says:

“he/she is the beneficiary of a petition (I-130) already filed with the US Immigration and Naturalization Service (INS) as the spouse of a U.S. citizen, but which petition has not yet been approved by INS…”

My question is: What happens to the people who have their I-130 petition approved by INS and now sitting at the NVC? Is it too late to qualify for the K-3?? In our case, the time that NVC had the paperwork was the largest chunk out of the whole process, almost 6 months.

If I was to marry Thai in Vietnam, could I file a k-2 visa? And would I have to file for this in his country?
What I am thinking is that I would have had to be married to him by a certain date. Am I right about this?
It seems to me that once you marry with this visa, your spouse automatically comes to the U.S. to wait out the process.
I dunno.  I have been studying is the k-1 visa for some time, and I don't know if now I should change my plan of action?

I get the impression that this new K-3 is best utilized now by people who have ALREADY filed an I-130, but are awaiting its approval. They can pioneer the process. That's what Alvena leads me to believe anyway, from reading her comments on alt.visa.us.marriage-based (where I got that link).

Sorry for the confusion, but I don't have the answer for you. Why don't you go to Alvena's website and post this question on her little bulletin board ? I'm sure she would answer you.
