I just got my first "Notice of Action" today!  I sent my petition off exactly a week ago, (I was thinking I wouldn't get anything for at least 2 weeks).

Anyway, it just says that they got my petition and my $110 smackers and that it takes from 70 to 100 days to process "the case"..

It's nice to see that they got both our names correctly and my address etc.. ;-)

SO I guess I'm officially on the books! LOL!

revision. I paid a lawyer $1000 to put n/t in a box clearly written, "do not put n/t". I did not get interview for 7 months....................now that is nerve-racking. You have no idea what the next 12-18 months are going to do to you. Put on your seat belt the roller coaster has begun. The good news is------they hardly ever reject these things.

... I am curious...

Why did they reject yours?

Just because you put "n/t" on it somewhere that you shouldn't have?

What happened to the 6 to 8 weeks?  I was hoping for 56 days max not 100.

Well, it was kind of a form letter with the "70-100 days" on it..  Whether it will take that long or that is the worst case scenario, I don't know.  Time will tell I guess..

There was a big article in the news back in february re: INS and the reason to increase fees...to add more civil servants to expedite paperwork more efficiently and to add more people to do background checks for visa applicants.
When I submitted my petition here in california this month a year ago..it was taking 6 - 8 weeks, mine was exactly 45 days. My wife tells me of a new FSU girl here whose husband recieved his "approval" in 4 weeks..and her Moscow interview was 6 weeks after that, so he beat my timeline by 2 weeks. I thought that his was faster because of the new organization at INS....but I guess your service center did not get the memo?? (smile)

The time will go faster than you think.

... in response to 70 - 100 DAYS??, posted by Apk1 on Jun 20, 2002

Well, it is also likely that they say "70 to 100 days" so you will not bug the helll out of them!  But I also know that depending on how many applications they have at the time etc.., it can be shorter.  I think they give the worst case scenario so that if they get it out quicker, they're hero's or something!

I don't know...  Like I said, I was surprised to get this first NOA after just a week.  Perhaps they rest will be quicker too!

There was a time - just a little over a year ago - when that same NE SC was sending out NOA's saying the timing was 70 - 100 days, while at the same time, the recorded message on their telephone line was saying 120 days - and in reality, it was closer to averaging 150 days.

I pointed this out in a scathing letter to my congressmen (all of them) that did absolutely no good whatesoever - well, except to prompt me to submit an additional form to pay for cabling rather than diplomatic pouch transfer of the approved petition.

From the point of receiving Approval, you still have some waiting to get Warsaw to open a provisional file (expedites matters just a little) and then schedule her interview (can be as long as 60 days after receipt of Approval).

Anyway - just be realistic about the time remaining and do your best not to be over-anxious.

I appreciate the info Dan..  I mean, I know all I can do is wait it out and hope that I caught them at a good time, you know?? ;-)
I am glad though, that I sunmitted everything because I do think that will shave off some time, them not having to wait for my girls things, because they are already with the petition!  But who knows..  Just cross my fingers I guess..

I know that Nebraska doesn't have a great rep for moving right along unfortunately, but there have been some guys who said they got approved rather quickly there, so I guess it depends on the traffic??

Time will tell... ;-)

The SC's (except for Vermont) all seem to be pretty inundated. They also seem to process certain types of petitions in bunches - so the I-130's will all sort of surge throught the system this week - and then next week it is time for the I-129's - and so on. Since NE is the sole SC responsible for K-3 and K-4 visas - they may suffer a bit more than some of the others at certain times when priority shifts.

What this means to you is that you don't know if your specific petition was on the 'front' end or the 'tail' end of one of those priority surges. If you happen to get lucky, I see timeframes at NE as short as 61 days during the past year - or the other end is more than 150 days (though I suspect that one had some problems of some sort).

In any case, it sounds like you have the right frame of mind. It is merely a waiting process.

I found a web site that shows timelines of processing (if people submit their info to this web site).  It shows the only one with full info as being started Last January and they were approved in 57 days (through Nebraska, and this was for a Ukrainian woman).  But then their interview date was 3 freaking months later!  I have no idea why!

So go figure! LOL!  It will be interesting to say the least..
