... in response to Question about Adoptions-, posted by Oscar on Jun 19, 2002Planning to in the near future...just started reading up on state laws concerning the requirements. If you do a search on adoption, you'll find links to every state and what their requirements are.
In case you didn't know, once the adoption is finalized, your child will automatically become a US citizen and be entitled to a US passport, even though Mom has not yet become a citizen. This will protect your child from deportation if he/she were to get arrested for any reason.
There was a well publicized case recently of a 19 year old college student who was arrested for some drug-related activity and was being deported to South Korea. This kid was not a citizen because his parents never bothered to become citizens (he had been in this country since he was 6 months old). The kid couldn't even speak Korean, but they were sending him back and he could never return to this country. What a kick in the pants.
While the INS might not be able to deport a permanent resident wife of a US citizen without great difficulty, it appears that her child, not being any legal relation to you unless you adopt, may not have any protection whatsoever.
