I'm trying to finish up the VISA paperwork tonight and I am a little confused by part of the Affidavit of Support.  Item number 10 states:

"That I have submitted visa petition(s) to the Immigration and Naturalization Service on behalf of the following person(s).  If none, state none."

Well, I hate to sound so dense, but am I supposed to list my fiancee and her son here or are they asking if I have any petitions for other people?  I think the correct answer is NONE but I have this lingering doubt.  Does anyone know the definitely correct answer for this?

Thanks,

John

Hi John-

I am just finishing up my papers as well..  I found on a couple of the web sites, example papers that you should put your fiancee and her son there and after both of their names put in "(Filing now with I-129F Petition)".

Hope that helps..

And are you doing a seperate I-134 for both her and her son or just one?  I have heard it both ways, so to be safe, I am sending two, one for her and one for him.

I have heard the same thing with the G-325A.  Some say you need a set for each person, others say the child just goes on the Mothers set.. I was not taking any chances so I did seperate sets for both..

Later,
Oscar

But your answer actually makes a lot of sense.  I would assume that they are looking to see if one's sponsored someone else previously, but this actually clears it up well.

Well, question 9 asks if you have submitted on anyone "previously".

Question 10 asks if you have submitted a petition on behalf of anyone.. Well, the answer is yes because that is exactly what you are doing now.

Like I said, I was confused about it to until I saw it on some of the example pages like on Doc Steens site etc..

It is very ambiguous.  Notice that question #9 is about affidavits of support and #10 is about visa petitions.

I just noticed this:  At the beginning of the form there is sufficient spaces provided for the primary person, a spouse, and up to 5 children.  Now, it stands to reason that if all of them needed to be listed on #10 then they would provide 7 spaces (instead of the 2 they provide).  That said, I still feel kinda safer doing it the way you first mentioned but I'm still thinking about it.

I am only planning on submitting one I-134 and one G-325A.  The G-325A for the child would be worthless anyway unless you get him/her to sign it.  And what if the child was only 2 or 3?  How would you get the signature then?  I simply don't see any way it could be a requirement.  What do you think?

I totally agree with you... but since we are dealing with such an ambiguous agency, kind of like the IRS, I am just not going to take any chances..  As I say, I have had people say to do it both ways on both the G-325A and the I-134, so to play it safe, I am doing one of each for both Mother and child..

Better to have it and not need it than need it and not have it!

Regarding question 10 on the I-134.. Go to the doc steen site and look at the example I-134 that is filled out.  They put the current fiancee in..

Good luck..
