What, if anything, do I need to have for the INS to prove that Stas' father gives permission for him to leave Ukraine?

Do I need any formal letters or documents?

Anyone?

If your girl has her divorce decree, you should be fine.  A letter from the ex-spouse is no longer needed.  You can check the Steen website and read this info and some other sites as well..

I am not able to speak for the States, but the Canadian Embassy WILL NOT issue a visa without a "No Objection" letter from the father, or a Ukraine Court Order allowing the minor to leave the country with the Mother.
There is an International Convention regarding this, that Ukraine is a signatory to.

Mark,

That is not to say that an ex cannot cause problems if he really wants to!  All he might have to do is bribe a judge, the police, etc..

Again, check the steen site and a few others about this.  They are pretty clear that you don't need the letters (formally) in Ukraine.  I cannot speak for other countries..

You will not need that for your petition, but later they could ask when she tries to leave the country with him.
It is not a requirement of INS, but of most countries due to minimize kidnapping. Ukraine might need a formal letter from him also, better have your fiance look into it before she gets close to her interview date...so you will have approx. 3-4 months from this stage of the game plan to get that in order, as long as the ex-husband is not greedy.

Who should we ask this question of? Is there an agency in Ukraine she should ask? Or do we need to hire a lawyer there?

I have been told that the father will make no effort to stop Stas from leaving, since he is remarried, and his mother thinks it will be good for Victoria to take Stas and go far away...

Ok.. Here you are Mark.. From the Doc Steen site and it is also on other sites as well..

"Another frequently asked question: Does the female fiance in Russia (FSU) or Ukraine have to have a statement from the father that the child is allowed to immigrate?

Answer: No, this is no longer necessary, as long as the fiance (mother) of the child has total custody of the child. (Please be aware, however, that in OTHER countries this may not be true. Canada, for instance, DOES require a statement from the father that the child can immigrate.)"
