And if so, when did you file your W-7? I filed mid January and have not gotten one yet. I guess that I'll just wait until 4/14 before I send in my taxes. Maybe I'll send a cover letter explaining my plight. I'm sure that I'll get plenty of sympathy (and an audit) for my troubles.

I filed for a TIN for my wife's son in mid-February. It arrived on April 1.  It took exactly 6 weeks from the date that I mailed the application.

I have had a lot of problmes with getting a Social Security number for my wife. Her application was rejected recently.  We received the notice seven weeks after she applied.  We contacted the local office a week before and got the run-around.  They said they couldn't find her file. Apparently, just like the INS, Social Security doesn't use computers.

My wife finally got her EAD card (backdated to Nov. 10, 2001)last month.  So, the day after her rejection letter arrived, we went back to our local Social Security office, showed them the EAD and filed an appeal.  We were told that SS had checked with the INS (Chicago) and INS told them that my wife was not work authorized.  They would have to check again and it would take a month (or maybe 2, 3 etc?).  So, I guess the INS has no record of who they issued EAD's to or when the were issued?  At this point nothing they do surprises me.

I filed for a TIN for my wife this week.  I will send off an extension request to the IRS on the 15th and file my tax forms whenever my wife gets either her SS number or her TIN.  The tax form is ready to go.  All I need is that number.

If her I-94 was stamped "work authorized" they have no reason not to issue her a SS#. I'd try dealing with another office.

My wife got her SS# processed the same day she applied however her card got "lost in the mail"...Right! We waited for six weeks until I had to have that # for her AOS application the next day. After talking to four different people I got them to give me her # over the phone. The first three were real @ss holes and kept telling me that they couldn't do it. The forth just said "no problem, her # is..." Don't give up and don't take no for an answer.

SSN is a lot quicker, it only takes a day if you have the EAD card from the AOS.

I got the SS# for my wife but I need the TIN for our daughter.

I tried to get a SS# for her too but they said that they couldn't because she wasn't "work authorized". I said that I had gotten a SS# for my son when he was three years old. They said that was because he was a US citizen and we would have to wait until she had her AOS. I said that she would still be only three years old and that she would still not be "work authorized". They were not amused with my logic.

Last year I filed my taxes, claiming my son as a dependent, but not realizing that he needed a TIN.  I received a notice from the IRS disallowing the dependent deduction, reducing our refund.  I contacted the IRS by phone, and they recommended getting the TIN, and then calling them back.  Once their computer was updated with the TIN, our refund was restored.

I applied for the TIN at our local IRS office, but then two months went by with no progress.  I returned to the office, complained (politely!), and they managed to straighten it out.

I'm no expert on taxes, but it seems to me that you might have several options:

1.  File a deadline extension, and pay any estimated taxes you think you might still owe, if any, then file when you receive the TIN.

2.  File, do not claim the deduction, and file an amended return later once you have the TIN.

3.  Do what I did, when the IRS catches the error, work it out with them.

No recommendations here, there may be other options, I would suggest a call to a tax specialist, just wanted to relate my experience.

I'll try to make it to an IRS office and straighten it out (surely there's been some mistake Smiley before I file but otherwise I'm filing the 14th and let them figure it out. It really shouldn't take three months to issue a friggin' number but after dealing with the INS and SS I'm somewhat prepared for the worst.

Probably better to drop the dependent for now and file a revision later. (I wouldn't want to confuse them Smiley I'm afraid if I throw them anything out of the ordinary that I won't see my refund until winter.

In my case, the IRS recalculated my tax obligation, and paid out the revised refund in what seemed like a normal amount of time.  Once I gave them (over the phone) my son's TIN, the remainder of the refund arrived in about a month.  I think you are wise to go with what you have now, and revise it later once you have the TIN. Had I realized my mistake before filing, this is what I would have done.
