Author Topic: Adjustment of Status Questions (INS no help)  (Read 2622 times)

I had a few questions concerning the adjustment of status process and forms.

1)  On the fiancee visa form, in the box marked beneficiary, there is a number A72324456.  Is this the alien registration number they ask for repeadetly on the forms?  I called the INS Customer Information Center and they referred me to Catholic Relief Charities to answer the question.

2)  I do not see it listed on the 485 form, but do I need to send all the documents I sent with the fiancee visa application that are not listed.

-  Divorce certificate;
-  Police certificates.

3)  My wife wants to use my last name.  How is the INS on this matter, or is better to file in the same name on the PASSPORT and original fiancee visa application?

4)  On the application to obtain a work permit, which will allow her to get an Social Security number, it says to file under the jurisidiction of fiancee visa.  If I do this, how long would the work permit be good for initially?

Thanks for the help!!!

Yes.

No, but you do need a certified copy of the marriage certificate.

We filed under the original, but it is probably better to file under her married name.  However, you probably will want to get advanced parole papers in both names if she is going back to Russia before becoming a permanent resident.  This will allow Russian passport control to see that the papers match with her passport.

If you file under her original name, you can ask that the card be issued in her married name at the interview.

4) On the application to obtain a work permit, which will allow her to get an Social Security number, it says to file under the jurisidiction of fiancee visa. If I do this, how long would the work permit be good for initially?

She is not a fiance once you marry.  She is an "adjustment applicant" and should file for a (c)(9) EAD, which is good for one year.  Otherwise they may give you one that is only good for 90 days.

Good luck,

Steve M.
