Visa denied... 1 year 8 months and still counting...

My Finacee has just been denied her visa after the first attempt. How does the process of resubmittoing the additional evidence they want work. I havent recieved anything from them yet but my fiancee has e-mailed me their reasons of why it was denied. I guess my big question is, are we thrown back to the back of the line. how long of a wait is it now?

Did they have her leave her international passport or have her take it home with her?

I just talked with her last night, and she told me she still has her passport. I wonder if I should just fly there marry her there and go for the K3... She was denied because they said she did not speak english during the interview, but she does speak english. She told me when the interview started the interviewer started off by speaking Vietnamese and never asked her to speak english so she kept talking in vietnamese. Whats your thoughts on her having the passport still or not?

I might make an appointment for another interview with both of you present, and go there yourself with all the evidence. It'll allow you  demonstrate how you communicate. Bring a giant binder with every piece of paper, photos, your passport stamps, phone bills, on and on. Look the interviewer square in the eye and ask him politely if he thinks you're committing fraud. That's what I'd do anyway.

IF they kept the passport, it is usually an indication at most consulates that they just need to flesh out the record a bit before granting. IN this case, this is really a matter of providing clear and convincing evidence of eligibility for the benefit requested.

Sorry to hear that Bigblock.  That really sucks.  If my novia gets denied for her visa, I'm going to Colombia to marry her and file the K-3.

If that fails, I'm flying her to Mexico and I'll just sneak her over the boarder myself!  I'll worry about the little details later!   ;)

Don't panic yet Mike and hang in there.

Your fiancee petition is still alive and they just want more evidence. This actually happens quite often and most get approved once you satisfy their questions and show your sincerity. If you were trying to run a visa scam, they would expect you to just drop everything and disappear from the radar.

Provide everything they are asking for with solid evidence to back up everything as much as possible.

When she goes back to turn in the new documentation, she probably won't meet with the consul but with an employee at the window. Why not have her converse with the person receiving her documents in English only to demonstrate her English language skills. Have her ask the window person to please make a note on her paperwork that she can speak and understand English!

I met a gringo at the US embassy who had been to the embassy four times trying to get his fiancee a K-1. On the fourth try he suceeded. Of course he was about 60 and she was about 22 or 23 but who knows if that had anything to do with it.

VISA APPROVED!!!!!!!! I submitted all the paper work they wanted and in about 2 days everything was approved and she will be holding her visa on the 30th of October.....phewwwwwww all this waiting nonsense is over, I cant believe it, but its true, Thank you everyone at this website for helping me in the Asian fourms throught my ordeal, you all helped me to keeep my sanity through al of this, thank you!!!!!!!
