switching beneficiary's country after filing for k1?
« on: July 20, 2010, 09:39:50 PM »
Wondering how hard it is to switch the beneficiary's location for a k1 visa. She is thinking about moving back to taiwan but not sure and she's not sure whether to put Taiwan (her mom's address) or Australia down as her mailing address. Wondering how hard it is to switch from the consulate in Sydney to the consulate in Taipei after filing the petition...

It can be done. You can do it by letter. . . .  Try contacting the customer service line.

It will probably depend on how far along the petition processing is when you request a change of consulates.

If the petition has already been approved by USCIS, then you may have to file Form I-824 ($340).

Personally, I would recommend that you wait a while until she makes up her mind before you file. That would be the least complicated way…

Definitely wait until she makes up her mind. I dont remember if AUstralia does police clearances but if they do  she will need one if she leaves to interview elsewhere if she has been there more than 6 months. The converse is also true.

Talked with her last night and we'll probably just list her mom's address as mailing address and do it in Taiwan. She was planning on visiting her mom again before she left anyways. She moves around a lot in Australia and thinking about taking some trips to a couple other countries so sounds like kind of a PITA to keep updating her address.

That sounds like the best course of action as it will probably be a lot less hassle for her if she just does it in Taiwan. Wherever you guys decide to have the interview, Good Luck!

Why does she not like living in Australia too much? Is it just because she is homesick?

Some homesickness, but mostly lonely. She's there by herself, gets the touristy stuff done pretty quick, no work to occupy her time...it's gotta be pretty boring at times. She was staying at a place with a crappy internet connection and just about went nuts. She's been traveling for almost 2 months now and I don't think she's ever been alone that long before. Whenever she was lonely where she worked she could hop on a train and go to her hometown for the weekend, but now she's kind of stuck out there by herself. I think also she's realizing how much better it is traveling with a loving boyfriend than traveling alone.
