RFE info needed
« on: October 18, 2007, 10:14:17 AM »
I received an RFE for the document I sent in to CSC for proof of the death of my novias husband.  I sent in a Registro Civil de Defuncion form.  It has the necessary information pertaining to his death.  The RFE states I need to send in proof that she is not currently married and that the marriage was legally terminated.  Doesn't proof of death show that she is no longer married?

What is the difference between a Registro Civil de Defuncion and a Certificado de Defuncion (Death Certificate)?   They both have the same information.  Do you think they want the actual certificate of death?

Here is what the RFE states:

DIVORCE/DEATH CERTIFICATE: Submit a legible final certified copy of the death certificate or divorce decree that has been filed in any Civil Court and signed by a judge or a legal authority showing the following prior marriage (s) were legally terminated for **** and ****.

Please help if you can!

Did you send them an English translation? If not, maybe that's what they want. And if that's the problem, don't forget to include the translator's statement that he or she is a competent translator and that it is an accurate translation. I forget the exact wording they want for the translator's statement, but it's listed on the INS/BCIS/Homeboy Secure-Is-Us (or what ever name they call themselves this week) web site.

I sent them a Registro Civil de Defuncion along with a certified English translation. I did not have any problems at any step of the process.
