case:  friend from china  comes on K1 visa to midwest finds b/f  is more obese than before and now has health and financial problems so man has friend who marries her and they apply for AOS so they go for interview and they turned down..now a chinese lawyer in usa says ok get divorce or annulment and marry the oringinal  k1 man  now is 45 days past 90days  but lawyer says since first k1 man had recent surgery that will get them extra time soooo  what do u think  first man is willing to marry her as he feels bad first man was midwest  2nd was florida

If she was here legally on a K-1 and got married (I don't care who she married) how can they deny her change of status?

Hmmmm. Interesting case. Here’s my advice:

1. China woman has head up her ass and obviously is only after a green card, any way she can get it. She is now here illegally and should get her self back to China now before they deport her sorry ass.

2. K-1 petitioner is an idiot. He really wants to marry her after she shtooked his friend? Does he want a wife or a sex slave? Tell him to forget about marriage and buy a blow-up doll…it’s cheaper.

3. CIS turned down AOS petition because there is NO exception. She MUST marry the petitioner on a K-1 within 90 days and NOBODY else.

4. Tell Florida man to go find his own damn mail order bride. What a cheap ass SOB!

5. Chinese lawyer is a dork and is only after their money. There is NO WAY the petitioner gets extra time on the 90-day marriage requirement because of surgery. There are NO exceptions. The lawyer should be reported to the bar for incompetence and as an accessory in immigration fraud.

Now tell me you just made up that silly story…

sorry  story is very true...now woman just wants out of the current marriage altogether and is prepared to go home  but wants be single..yes florida was sex only from here and is spending his pension on viagra   sorry to say he is retired naval capt

I have no idea if she has grounds for an annulment. Every state has it's own laws and she needs to put down some money for an attorney. Divorces are generally a hundred times easier than an annulment but she needs a REAL attorney for legal advice, not that charlatan who has been advising her on how to break the law.

If this story is true, then I am appalled at the behavior of EVERYONE in your story. No wonder it’s so difficult for the rest of us to get through the visa process with a bunch of self-serving bozos like that who have no respect for the law, including that stupid ass lawyer.

Tell you Chinese lady friend to hire a divorce lawyer or let her “husband” handle the divorce while she is back in China where she belongs. She does not have to be present here to finalize a divorce here. Tell her to marry a nice Chinese guy from her home province or stay single. I doubt she would ever be able to explain away her current situation if she were ever to apply for another U.S. visa.

maybe it is me but feel that the woman who i have met in china socially is naive and really wanted to marry(maybe not love) and would have stayed with him forever then was scared as she gave up good job as a chemical engineer then just ignorance and bad advice...i got asked to help as i am seeing a chinese lady  i met over 2 years ago in china and is a doctor who is here in usa on J1 visa good for 5 years  as she is an expert on diabeties the university hospital wants her accept a job and head her own research team   she told me as a J 1  she gets paid from research grant but pays no taxes so better for her than work visa glad my taxes pay for me and her   lol

Naivete and ignorance are no excuse. The bottom line is that she violated the terms of her K-1 visa and there is NO WAY she can adjust status or stay here legally. Marrying an American can get most immigration violations forgiven and allow adjustment as an immediate relative of a citizen, BUT K-1 is a special case and there is no forgiveness for marrying the wrong guy. She has to leave, married or not. The longer she overstays the harder the penalties down the road.

Hi Ray,

So, no matter what if a guy doesn't marry the lady within the 90 day period she has to go back.  What if the lady goes to live with a Family member and hides?  I guess if they eventually find her she will be deported and never allowed back in the country?

I’ve seen it happen where a couple marries a couple of days beyond the 90-day mark for a fiancée visa and they wouldn’t allow her to adjust status. She had to go home and start all over with a spouse visa petition. They are pretty strict on that, but I think it’s still somewhat of a judgement call by CIS.

If she does not marry within 90 days and goes into hiding, then she’s now another of the millions of illegal aliens in the U.S.  She can’t get a regular job or a driver’s license (well, in most states). If she eventually marries someone else, she will not be allowed to adjust status and stay here. Practically speaking, she may never be caught or deported unless she is busted for committing a crime. If she leaves the country, she might be banned forever from coming back, depending on how long she overstays and other factors.

Yep, been listening to Handel for many years, but not quite every day.

I love his legal advice show (Handel on the Law) on Saturday mornings. I’m surprised he hasn’t been disbarred yet. I crack up when he tells guys to save the money on a divorce and just have her killed instead. Sounds like Stephen's kind of lawyer...  :lol:

For those across the country wondering what the heck these guys are talking about, you can catch it on streaming audio from 640AM KFI from 5am to 9am (when Rush takes over) M-F PST and 6am to 11am on Saturdays.  Handel on the News (6-7, 8:30-9) is awesome for your morning drive into work.
